Uniform Law for International Sales under the 1980 United Nations Convention 4th revised edition
[Price: $211] [Rate] [Comments (0)] [Date: 2009-11-18]
Now ratified by 73 countries from every geographical region, representing every stage of economic development and every major legal and economic system, the United Nations Convention on Contracts of the International Sales of Goods (CISG) has changed the way international sales contracts are drafted and resulting disputes settled. In the decade since the Third Edition of Professor John Honnold's classic commentary, there has been vast growth in the number of decisions from tribunals around the world which have applied the CISG, an explosion of new scholarly analyses of the Convention, and remarkable developments in the research infrastructure that permits access to those materials. These developments have raised many new issues, and have deepened our understanding of (or, in some instances, effectively resolved) old ones. The remarkable progress of this epoch-making uniform international law calls for an updated edition of Professor Honnold's treatise. This Fourth Edition retains the original's incisive article-by-article commentary, as well as its insistence on how the parties' duties and the corresponding remedies need to work together (like scissor-blades, to quote Professor Honnold's vivid simile) and the many concrete examples that illustrate and test the Convention's response to problems that arise in international trade. It deals definitively with the crucial aspects of sales contracts, including the following, taking fully into account the myriad variations among distinct legal systems: delivery of the goods and handing over of documents; conformity of the goods and third party claims; remedies for breach of contract by the seller; payment of the price; taking delivery; remedies for breach of contract by the buyer; anticipatory breach and instalment contracts; damages; interest; exemptions; effects of avoidance; and preservation of the goods conclusion ( formation) of contracts. In explicit recognition of Professor Honnold's unique understanding of the Convention's development and the issues that occupied those who drafted and finalized the text, the substantial new textual material incorporated into this new edition is set in bold italics, allowing the reader to distinguish the work of the editor from text preserved from earlier editions, and thus identifying the material that carries Professor Honnold's special authority. Over three decades Professor Honnold's almost intuitive grasp of the instrument has guided governments, tribunals, scholars and practitioners towards an enlightened international understanding of the treaty. This new edition provides tribunals, practitioners, and scholars with even more invaluable insights into the meaning of each article of the Convention. The hundreds of decisions cited, many of them dating from the last few years, will continue to influence the promotion of international sales contract uniformity, encourage the settlement of disputes, and help to reinforce consensus in the application of the Convention.

American aviation didn't start in a corporate boardroom or a government committee. It began as a craving in the guts of adventurers to escape earth's grip and soar aloft. First, the Wrights left the windswept sands of Kitty Hawk, then barnstormers rose from cow pastures to chase dreams in fabric-covered crates. Some made it, while many did not. The survivors cleaned grease from their fingernails and donned G.I. uniforms to win a far-flung war in the 1940s. Then, they came home to build the world's greatest airline industry. Our astronauts launched from Capes Canaveral and Kennedy in the 1960s, paving the way to the moon and beyond. And now, privately funded adventurers are rising from Mojave, again reminding us the American Dream can be ours if we seek it. Records and feats of others exist as challenges, and dreams are there to chase!

Iron Fists
[Price: $59.98] [Rate] [Comments (0)] [Date: 2009-11-18]
It was just over 60 years ago that Adolf Hitler and Benito Mussolini, two of the world's most powerfully imposing leaders, died and their regimes crumbled. One of the most illuminating facts about this dark era of history is the way in which these tyrants, and others like them, used graphic design as an instrument of power. But how did these regimes succeed in influencing the minds of millions? It is in the visual language the imagery, the typeface, the color palette that the answers truly take shape. Phaidon Press is pleased to announce the publication of Iron Fists: Branding the 20th Century Totalitarian State by Steven Heller, the first illustrated survey of the propaganda art, graphics, and artifacts created by the totalitarian governments of Nazi Germany, Fascist Italy and the Communist regimes of the USSR and China. The book sets the disturbingly powerful graphic devices in historical context. The infamous symbols produced by these regimes are recognized universally: the swastika and gothic typography of Hitler's Germany, Mussolini's streamlined Futurist posters and Black Shirt uniforms, the stolid Social Realism of Stalin's USSR and Mao s Little Red Book. Author Steven Heller, a world-renowned design historian, who has long collected two-and-three-dimensional examples from this period, reveals how these symbols were used in a wide variety of propaganda, from posters, magazines and advertisements to uniforms, flags and figurines. In addition to using logos and symbols, all of the leaders researched in this book deliberately cultivated certain personal characteristics (Hitler's mustache, Mussolini's baldness, Lenin's goatee, Mao's smile), in an attempt to transform their corporeal selves into icons. These regime personalities were blanketed across public venues, from monuments to postage stamps. The Nazis, for example, installed an intricate graphic program that featured Hitler s face as a ''logo,'' a system remarkably similar to modern corporate identity creations. By integrating color images of artifacts with archival black and white photographs, Iron Fists offers unique insight into how these regimes were effective in using graphic design to further their causes. In the section on Fascist Italy, for example, there are numerous reproductions of stylized posters, magazines and handbooks designed to excite impressionable youth. Heller then connects this printed propaganda with historic photographs of Italian children dressed as men prepared for battle stoic and serious their small hands clutching guns instead of toys. Divided into four sections by regime, Heller also explores the color systems (each dictatorship had a distinctive palette), typefaces, and slogans used to both rally and terrorize the populace. In result, he demonstrates how these elements were used to ''sell'' the totalitarian message. The first extensively illustrated book on the subject, Iron Fists will have an obvious appeal to graphic designers but will also be an importa...

Fast Food, Fast Talk
[Price: $31.48] [Rate] [Comments (0)] [Date: 2009-11-18]
Attending Hamburger University, Robin Leidner observes how McDonald's trains the managers of its fast-food restaurants to standardize every aspect of service and product. Learning how to sell life insurance at a large midwestern firm, she is coached on exactly what to say, how to stand, when to make eye contact, and how to build up Positive Mental Attitude by chanting "I feel happy! I feel terrific!"Leidner's fascinating report from the frontlines of two major American corporations uncovers the methods and consequences of regulating workers' language, looks, attitudes, ideas, and demeanor. Her study reveals the complex and often unexpected results that come with the routinization of service work. Some McDonald's workers resent the constraints of prescribed uniforms and rigid scripts, while others appreciate how routines simplify their jobs and give them psychological protection against unpleasant customers. Combined Insurance goes further than McDonald's in attempting to standardize the workers' very selves, instilling in them adroit maneuvers to overcome customer resistance. The routinization of service work has both poignant and preposterous consequences. It tends to undermine shared understandings about individuality and social obligations, sharpening the tension between the belief in personal autonomy and the domination of a powerful corporate culture.Richly anecdotal and accessibly written, Leidner's book charts new territory in the sociology of work. With service sector work becoming increasingly important in American business, her timely study is particularly welcome.
